Acceptance

These terms govern your use of onlytradeoffs.net, operated by RhinoCuda Pty Ltd (ABN 75 609 122 527) of Suite 4/155 Denman Avenue, Caringbah NSW 2229. By using the site you agree to these terms.

The content is general information, not advice

The site content, including the essays, the signature memo, The Read, and the tradeoff lens and frameworks, is general information and education. It is not financial product advice, investment advice, legal, tax, accounting, medical or psychological advice, and it does not take account of your personal circumstances, objectives or needs. We are not a licensed financial adviser and nothing on the site is a recommendation to make any financial or investment decision. You are responsible for your own decisions and should seek your own licensed professional advice before acting. Reading the site or subscribing to The Read does not create a client, advisory or professional relationship.

Intellectual property

All content on the site, including text, the essays and memo, the books and extracts, the diagrams and the frameworks, is owned by RhinoCuda Pty Ltd or Michael Barrett, or used with permission, and is protected by law. You may read and share links, but you may not reproduce, republish or use the content commercially without our written permission.

Acceptable use

When using the site, you must not:

  • (a) use it for any unlawful purpose or in breach of these terms;
  • (b) copy, scrape, harvest or systematically extract content except as expressly permitted;
  • (c) interfere with or disrupt the site, its security or its underlying infrastructure;
  • (d) introduce any malicious code, or attempt to gain unauthorised access to any part of the site or its systems;
  • (e) infringe our intellectual property rights or those of any third party; or
  • (f) misrepresent your identity or affiliation.

We may suspend or withdraw your access to the site, in whole or in part, if we reasonably consider you have breached these terms or that suspension is necessary to protect the site or other users.

The Read

The Read is our newsletter, sent to subscribers who have opted in. You may unsubscribe at any time. See our Privacy Policy for how we handle your information.

The site may link to third-party sites. We are not responsible for their content or practices, and a link is not an endorsement.

Disclaimers and limitation of liability

The site is provided on an "as is" basis. To the maximum extent permitted by law, we exclude liability for loss arising from use of the site or reliance on its content. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law, or under any other consumer protection law that applies to you in your place of residence, that cannot lawfully be excluded, restricted or modified by agreement.

Where a consumer guarantee, right or remedy cannot lawfully be excluded but can be limited, our liability for a breach of it is limited, at our option, to re-supplying the relevant content or service, or paying the cost of having it re-supplied. Subject to the rights and remedies that cannot be excluded, we are not liable for any indirect, incidental or consequential loss, or for any loss of profit, revenue, data or goodwill, arising from your use of the site or reliance on its content.

Governing law

These terms are governed by the laws of New South Wales and the Commonwealth of Australia.

Changes

We may update these terms from time to time. Any changes apply from the date the updated version is published on the site, and only to your use of the site after that date. We will take reasonable steps to bring material changes to your attention, for example by posting a notice on the site or, if you subscribe to The Read, by email. If you continue to use the site after changes take effect, you accept the updated terms.

Severability

If any provision of these terms is or becomes invalid, illegal or unenforceable, that provision is to be read down to the minimum extent necessary, or severed if it cannot be read down, and the remaining provisions continue in full force and effect.

You can contact us, including with any question or complaint about the site or these terms, at enquiries@onlytradeoffs.net. Where these terms refer to us notifying or contacting you, we may do so at the email address you have given us, for example when you subscribe to The Read. A notice we send by email is taken to be given when sent.
